These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the contractual relations between MERLE Dominique (hereinafter the “Seller”) and any natural or legal person (hereinafter the “Buyer”) wishing to make a purchase on the website saintennemond.com. Any order placed by the Buyer implies unreserved acceptance of these GTC.

2. Products and Services

The products or services offered for sale are those listed on the website saintennemond.com. The Seller takes the greatest care in the presentation and description of the products to best inform the Buyer. Photographs and descriptions are for illustrative purposes only and are not binding on the Seller.

3. Pricing

The prices of the products are indicated in EUR (inclusive of all taxes – TTC).

  • VAT non-applicable, article 293 B of the French General Tax Code (CGI).
  • Prices may be changed at any time, but the price invoiced to the Buyer is the one in effect at the time the order is confirmed.
  • Prices do not include delivery charges, which are billed separately and indicated before the order is confirmed.

4. Orders

  1. The Buyer selects the product(s) they wish to order.
  2. The Buyer validates their cart/order after checking its content.
  3. The Buyer fills in the delivery and billing information.
  4. The Buyer chooses their payment method and proceeds with the payment.
  5. The sale will only be considered final after the Seller has sent the Buyer confirmation of the order acceptance by email, and after full payment of the price has been collected.

5. Terms of Payment

Payment for orders is made by:

  • Bank card (credit/debit card) via the secure STRIPE platform
  • Bank transfer (the order is processed only upon receipt of payment)

6. Delivery

  • Delivery Area: Products are delivered to the address indicated by the Buyer, within the zones we serve (Metropolitan France, Luxembourg, Belgium, Germany).
  • Timeframes: The Seller undertakes to ship the order within one (1) business day from the validation of payment. Transport times are those of the chosen carrier, CHRONOPOST.
  • Risks: The risk of loss or damage to the products is transferred to the Buyer when the Buyer, or a third party designated by them, takes physical possession of the products.

7. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Buyer has a period of fourteen (14) days from the receipt of the product to exercise their right of withdrawal without having to give reasons or pay a penalty.

  • Return Conditions: The product must be returned in its original packaging, in perfect condition.
  • Exceptions : This right does not apply (subject to legal exceptions) to services fully performed before the end of the withdrawal period, personalized products, or goods unsealed after delivery that cannot be returned for reasons of hygiene or health protection.

8. Guarantees

  • Legal Guarantee of Conformity: The Seller is liable for delivering goods that conform to the contract and for defects in conformity existing at the time of delivery. The Seller is also liable for defects in conformity resulting from the packaging, assembly instructions, or installation when the latter was carried out under the Seller’s responsibility or was included in the contract. Concerning wine, a product is considered non-conforming if it does not match the contractual designation (vintage, appellation) or if it presents a defect that renders the product unfit for normal consumption (corked bottle, oxidized, etc.). The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.
  • Guarantee against Hidden Defects (Latent Defects): The Seller is bound by the guarantee against hidden defects in the item sold which render it unfit for the use for which it was intended, or which diminish that use so much that the Buyer would not have acquired it, or would have paid a lower price for it, had they known of them. The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

9. Responsability

The Seller cannot be held responsible for damages resulting from improper use of the purchased product or for indirect damages. The Seller’s liability cannot be engaged in the event of force majeure (unforeseeable and irresistible event).

10. Protection of Personal Data (GDPR)

The Seller undertakes to preserve the confidentiality of the information provided by the Buyer. All information concerning the Buyer is processed in accordance with our Privacy Policy, available at GDPR.

11. Disputes and Applicable Law

These General Terms and Conditions of Sale are subject to French law.

  • Mediation: In the event of a dispute, and in accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, the Buyer may have recourse to the mediation service to which we belong: MEDIAVET BP 80536 – 31673 LABEGE CEDEX.
  • Competent Jurisdiction: Any dispute not resolved by mediation shall be brought before the judicial court (Tribunal Judiciaire) of Bourg en Bresse (France).
